We are committed to providing our Internet services as an open platform for innovation, investment, job creation, economic growth, competition, and free expression. We do not block any lawful content, applications, services, or your use of non-harmful devices, or discriminate in transmitting lawful network traffic except as reasonably necessary to manage our network effectively for the benefit of our customers as described below. The purpose of this disclosure is to make available information regarding our network management practices and the performance and commercial terms of our broadband Internet access services to enable you to make informed choices regarding the purchase and use of our services, in accordance with Part 8 of the Rules of the Federal Communications Commission.
Service Offerings and Performance
Our Internet service options and pricing are posted at www.archtopfiber.com.
Services are described as offering “up to” certain speeds. While we engineer our network to achieve the speeds for each of the service tiers we offer, we cannot guarantee that customers will always experience those speeds. Speeds can vary depending on variables including the following:
- Type of connection between a customer’s devices and our network. For example, Wi-Fi connections may be slower than wired connections.
- Performance of a customer’s computer, tablet, smartphone and other devices including its age, processing capability, operating system, the number of applications running simultaneously, and the presence of any malware or viruses.
- The distance packets travel (round trip time of packets) between a customer’s devices and its final destination on the Internet, including the number and quality of the networks of various operators in the transmission path. Traffic may traverse the networks of multiple providers before reaching its destination, and the limitations of those networks can affect the speed of a connection.
- If a large number of visitors are accessing a site or particular destination at the same time, your connection will be affected if the site or destination does not have sufficient capacity to serve all visitors efficiently.
- To control traffic or performance, a website or other data host may limit the speeds at which a visitor can download content.
Actual speed and latency may vary depending upon these and other factors. Absent the factors described above, we generally expect that actual speeds will equal or exceed the advertised speeds. As a new service provider, Archtop is still collecting and studying data to be able to post typical speed and latency performance for each of its service offerings and will post illustrative information as it is available.
Customers may test service speeds using commercial speed tests available online, including on our website and the Plume HomePass app. If tests from your ONT to our network are consistently below your package speed, please contact us for assistance. However, please note that all speed tests have biases and flaws, and should be considered only as informational and not a reflection of actual performance.
Use of our telephone services will not materially affect your Internet performance. If we deliver other Internet Protocol based services or any specialized or managed services in the future that would likely affect your Internet services, we will provide additional information as appropriate.
Network Management
Blocking. We do not block or otherwise prevent end user customer access to lawful content, applications, services, or non-harmful devices. We attempt to block commonly known malware and malicious ports and protocols and engage in reasonable network management practices as described herein.
Throttling. We do not degrade or impair avoid any degradation or impairment of access to lawful Internet traffic on the basis of content, application, service, user, or use of a non-harmful device. Where service congestion occurs, service speed may be temporarily reduced, but on our fiber network we expect such instances would be uncommon and brief.
Prioritization. We do not engage in any practice that directly or indirectly favors any of our affiliates’ traffic over other traffic, or that directly or indirectly favors some traffic over other traffic in exchange for consideration, monetary or otherwise.
Congestion Management. We use reasonable network management practices that are consistent with industry standards, which may include: monitoring internet edge core and backbone links and taking action to increase capacity when links cross predetermined capacity thresholds; employing standard practices for congestion management; identifying spam and preventing its delivery to customer email accounts (where offered); detecting malicious Internet traffic, and preventing the distribution of, or inadvertent access to, malware, phishing, viruses, or other harmful code or content.
Application-Specific Behavior. Our telephone service traffic is be prioritized to ensure voice quality and phone functionality. We do not otherwise inhibit or favor certain applications or classes of applications. We do not block or rate-control specific protocols or protocol ports (except to defend against malicious attacks and identity theft) or modify protocol fields in ways not prescribed by the protocol standard.
Commercial Terms of Service and Privacy Policies
Your use of the services constitutes an agreement to comply with our terms of service, Acceptable Use Policy and Privacy Policy each posted at www.archtopfiber.com/policies. We may restrict, suspend, or terminate service to enforce these policies and to protect our network and the experience of other users. The service is also subject to the terms of any contract entered by the customer, which may include penalties for early termination of service.
Equipment
You may use a compatible router from a third party, provided that any attachment you use does not harm our network or cause interference to other users. Residential customers may not connect any type of server to their service.
